Can Do Accounting, no more: Tax agent terminated by TPB

Can Do Accounting’s tax agent has been terminated by the TPB for “serious breaches” of the Professional Code of Conduct.

The Tax Practitioners Board has terminated the tax agent and sole operator of Can Do Accounting, Ruaidhri Carslake, and applied a two-year ban on the company for re-registering.

The TPB found Can Do Accounting, led by Carslake, misrepresented its supervisory arrangements over four years and had lodged over 3,000 returns without proper oversight.

It was noted that Carslake had never been a registered tax agent and had falsely listed supervising agents without their consent or involvement.

From this investigation, the TPB has imposed a two-year ban on re-registration for Can Do Accounting, and concluded Carslake was “not a fit and proper person to be involved in the provision of tax agent services”.

Peter de Cure, TPB chair, said Carslake fell short of the expectations required by a company director.

“He abused his position of influence and trust in his small community, putting his clients at risk by lodging on their behalf without the necessary qualifications and skills required of a registered tax practitioner,” he said.

“This termination emphasises the need for adequate supervision and the competent provision of tax agent services and helps to maintain the quality and reliability of services provided to clients.”

 
 

Once the TPB deemed Carslake as not a fit and proper person, Can Do Accounting applied to the Administrative Review Tribunal for a review of the decision, before it was subsequently withdrawn and the termination took effect.

“This decision helps safeguard the community by ensuring only individuals with the proper qualifications and registration prepare and lodge tax returns,” the TPB said.

“As a result, Can Do Accounting is no longer able to provide tax agent services. More recently, the TPB also terminated the registration of Can Do Advisory Pty Ltd.”

From the outcome and details of the case, the TPB warned the tax practitioner community not to allow unregistered individuals to use their registration to provide tax agent services to their clients as it is unlawful and breaches the code.

This warning was also extended to the broader taxpayer community to remind them of the importance of checking if the person or company they had engaged to prepare their tax return was properly registered with the TPB, which could be checked against the TPB public register.

De Cure said the TPB would actively monitor tax practitioners and their responsibility for proper supervision and control and urged the community to report any suspected unregistered activity.

“Cases like these have a detrimental impact on public confidence in the tax profession. We will continue to reinforce the importance of honesty and integrity and ensure tax agents adhere to high ethical standards.”
